If a member needs to seek medical attention due to an injury or exposure at the workplace they should complete the appropriate WSIB forms (see below). A functional abilities form and a EIR/EIR-A form also needs to be completed. The EIR form notifies the board and school about the incident. The board would like this form to be completed within 48 hours.
For a work related injury/illness Form 6 needs to be completed from the WSIB website.
For exposure to a leak, spill, and other chemical substances Form 3958A needs to be completed from the WSIB website.
The doctor needs to complete Form 8 from the WSIB website, let them know it is a workplace injury.
The employer must provide a copy of the employer’s report of injury/disease (form 7) to the member.
WSIB is considered first payer. If WSIB rejects the claim, a member may still be eligible to access their sick bank for days missed as a result of a workplace injury/exposure.
The WSIB claim must be filed no later than 6 months from the date of the accident/incident/exposure. If it is a workplace related incident and you fail to file a WSIB claim first, it can impact your ability to get sick leave pay from the employer and may also interfere with a Long Term disability claim.
WSIB typically appoints a Case Manager and an Eligibility Adjudicator to make decisions, and they may discuss the claim with a member. Members should engage in discussions with WSIB. All conversations with WSIB are documented. If a member is approved for WSIB, HDSB will continue to pay the member, and continue to make sure their pension contributions continue to be made to the Ontario Teachers’ Pension Plan.
If you stay on WSIB for 24 months, you will then only have 6 months to submit an application for Long Term Disability. Members can be on an approved WSIB claim and on an approved LTD claim at the same time.
